Terms of Use

What this site is, and what it isn’t.

Effective October 26, 2026 · utilitybillrecovery.com

Using utilitybillrecovery.com means accepting these terms. They're short because the important points are few.

What we are

Utility Bill Recovery reviews utility accounts for cannabis cultivation operations — recovering billing overcharges, testing rate and demand treatment, pursuing incentives, reconciling water and sewer charges, and providing ongoing account oversight.

What we are not: a utility company, a public utilities commission or any other regulator, a law firm, an accounting firm, an engineering firm, or a government program administrator. We are not affiliated with any utility provider. Nothing on this site is legal, tax, accounting or engineering advice.

Our guarantee

If we can’t save you money, we don’t charge. No retainer, no upfront fee, and no charge for the initial review of your bill.

ServiceWhat we chargeIf we find nothing
Bill audit and recovery25% of money actually recovered — refunds and credits posted to your account. We do not charge for forward-going savings produced by a rate or billing correction; those are yours. No fee
Monthly energy savings programAn amount equal to three months of the savings achieved. If the program does not reduce your bill by at least 10%, there is no charge for that service

Fees become payable on recovered money once it reaches your account — not when a claim is identified, submitted or approved. Those are four different stages and we invoice on the last one.

What the guarantee does and doesn’t cover

The guarantee is about your exposure, not about the outcome. It means you cannot lose money by having us look. It does not mean we can promise a result.

We do not promise in advance that your account contains recoverable money, what any recovery or saving will amount to, how long a utility or program administrator will take, or that they will approve anything at all. Those decisions rest with your provider, under rules, tariffs, budgets and deadlines they control and can change without notice to us. What is recoverable also depends on the facts of your account, which records survive, filing deadlines, and implementation on your side.

Any figures shown on this site — including past results and sample reports — are illustrative or rounded, describe particular accounts under particular conditions, and are not a prediction about yours. Past results do not guarantee a future outcome.

Information on this site

Guides and explanatory material are general information about how cultivation utility billing works. They are not advice about your account, and acting on them without a review of your own records is at your own risk. We try to keep everything accurate and current; tariffs and program rules change constantly, and we don't warrant that every page reflects the latest position.

Submitting information to us

When you send us an enquiry or records, you confirm you're authorised to share them on behalf of the account holder. Please don't send material you're not entitled to disclose. An enquiry does not create an engagement — a written agreement does.

Our material

The content, structure, reports and methodology on this site belong to Utility Bill Recovery. You're welcome to read, print and share pages for your own business purposes. Republishing our material as your own, or using it to build a competing service, isn't permitted.

No warranties

This website and everything on it are provided as is and as available. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the site will be uninterrupted, secure or error-free, that defects will be corrected, or that any guide, calculation, figure or example on it is accurate or applicable to your account. Tariffs, program rules and filing deadlines change frequently and without notice to us.

Fee terms

The percentages and thresholds above describe our standard arrangement. The fee basis, scope of work and any variation for your engagement are set out in a signed written agreement between us, and that agreement governs. Nothing on this website creates an engagement, varies one, or should be read as a term of one.

No professional relationship

Reading this site, submitting an enquiry or speaking with us does not create an attorney-client, accountant-client or other professional relationship. We are not a law firm, accounting firm or engineering firm, and our work does not replace advice from one. Where a matter needs that advice, we will say so.

Liability

To the fullest extent the law allows, our liability arising from your use of this site is limited to the amount you've paid us, if any. We're not liable for indirect or consequential loss, including lost savings or lost recovery opportunities, arising from site content. Nothing here limits liability that cannot lawfully be limited.

Links

Where we link to a utility, program or third-party resource, we don't control it and aren't responsible for it.

Dispute resolution and arbitration

Please read this section carefully. It affects how disputes between us are resolved, and it limits the ways you can bring a claim. It contains a class action waiver, and it gives you 30 days to opt out.

Informal resolution first. Before starting arbitration, the party with the complaint will send the other a written notice describing it and what they want, to support@utilitybillrecovery.com or to our business address. We will both try in good faith to resolve it for 30 days from that notice. Most things end here.

Binding arbitration. If informal resolution fails, any dispute arising out of or relating to these terms, this website, or our services will be resolved by final and binding arbitration rather than in court, administered by JAMS under its Streamlined Arbitration Rules (or, by agreement, by the American Arbitration Association under its Commercial Rules). This agreement is governed by the Federal Arbitration Act. Arbitration will take place in the California county where you are located or, by agreement, by videoconference or on documents alone. A single neutral arbitrator decides. The arbitrator must apply California law, may award any remedy a court could award to that party individually, and must issue a written, reasoned award.

Mutual. This section binds us exactly as it binds you. We cannot take you to court on a matter we require you to arbitrate.

Costs. Where you are the claimant, we will pay the arbitration filing, administrative and arbitrator fees that exceed what it would have cost you to file the same claim in court, unless the arbitrator finds the claim was frivolous. Each party otherwise bears its own attorneys’ fees, except where a statute or contract provides otherwise and the arbitrator awards them.

What is excluded. Either of us may instead:

Public injunctive relief. Nothing in this section waives the right to seek public injunctive relief. If a claim for public injunctive relief is brought, that claim proceeds in court and is stayed pending the arbitration of the remaining claims.

Class action waiver. Claims are brought in an individual capacity only, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this class action waiver is held unenforceable as to a particular claim, that claim — and only that claim — is severed from arbitration and proceeds in court, while the remaining claims are arbitrated. If the whole of this arbitration section is held unenforceable, disputes go to the courts identified below.

Your 30-day right to opt out. You may reject this arbitration section by sending written notice within 30 days of first accepting these terms to support@utilitybillrecovery.com with the subject line “Arbitration Opt-Out”, stating your name, company and that you are opting out. Opting out costs you nothing, changes nothing else about our relationship, and will not affect any current or future engagement. If you opt out, disputes go to the courts identified below.

Survival. This section survives the end of these terms and of any engagement between us.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Where a dispute is not subject to arbitration — because it is excluded above, because you opted out, or because a court holds the arbitration section unenforceable — it will be brought in the state or federal courts located in California, and we each consent to their jurisdiction.

Changes

We may update these terms. The effective date above tells you when they last changed.
